BEHANDLING AF PERSONOPLYSNINGER

Den dataansvarlige klinik overholder gældende regler i databeskyttelsesforordningen (GDPR) og relevant dansk lovgivning for både psykologer og læger/psykiatere.

1. FORMÅL MED BEHANDLING AF PERSONOPLYSNINGER

Personoplysninger behandles for at kunne:

· Gennemføre psykologisk og psykiatrisk udredning og behandling

· Føre journal i overensstemmelse med gældende lovgivning

· Sikre relevant kommunikation med patienter og evt. pårørende

· Administrere aftaler, henvisninger og betaling

· Overholde lovkrav om dokumentation, indberetning og opbevaring

2. HVILKE PERSONOPLYSNINGER BEHANDLES

Der behandles kun relevante og nødvendige oplysninger, herunder:

· Almindelige oplysninger: navn, adresse, telefonnummer, e-mail, CPR-nummer

· Følsomme oplysninger: helbredsoplysninger, psykologiske og psykiatriske vurderinger, testresultater, behandlingsoplysninger, medicinoplysninger

· Supplerende oplysninger: sociale forhold, skoleoplysninger, pårørende

· Administrative oplysninger: fakturering, forsikring, henvisninger

3. INDSAMLING AF OPLYSNINGER

Oplysninger indsamles typisk via:

· Samtaler (fysiske, telefoniske eller digitale)

· E-mail og anden sikker kommunikation

· Patienten selv eller forældre/pårørende

· Tidligere journaler eller samarbejdspartnere (med samtykke)

4. RETSGRUNDLAG FOR BEHANDLING

Behandlingen sker med hjemmel i:

· Databeskyttelsesforordningen (GDPR) art. 6 og 9

· Databeskyttelsesloven §§ 7–8

· Sundhedsloven §§ 15–17

· Autorisationsloven

· Journalføringsbekendtgørelsen

· Lov om psykologer m.v. § 14

· Bekendtgørelse om psykologers journalføring

Almindelige oplysninger behandles bl.a. for at opfylde en kontrakt, mens helbredsoplysninger behandles som led i sundheds- og behandlingsydelser.

5. VIDEREGIVELSE AF OPLYSNINGER

Personoplysninger videregives kun når:

· Der foreligger samtykke

· Det er nødvendigt for behandling (fx til læge, apotek)

· Det er lovpligtigt (fx underretningspligt eller indberetning)

Der videregives ikke oplysninger til kommercielle formål. Oplysninger overføres ikke til lande uden for EU/EØS.

6. TAVSHEDSPLIGT

Alle oplysninger behandles fortroligt i overensstemmelse med:

· Sundhedslovgivning

· Psykologlovgivning

· Etiske retningslinjer

Der gælder tavshedspligt med undtagelse af lovbestemte indberetningspligter, fx ved risiko for skade på patient eller andre.

7. SIKKERHED OG DATASIKRING

Der er implementeret både tekniske og organisatoriske sikkerhedsforanstaltninger:

· Krypterede journalsystemer med adgangskontrol

· Sikker digital kommunikation

· Aflåst opbevaring af fysiske dokumenter

8. OPBEVARING OG SLETNING

· Patientjournaler opbevares i henhold til lovgivningen:

o Minimum 5 år for psykologer

o Minimum 10 år efter seneste kontakt i sundhedsvæsenet

· Oplysninger slettes, når de ikke længere er nødvendige eller lovpligtige

9. DATABEHANDLERE

Der anvendes kun databehandlere, der lever op til GDPR-krav. Der indgås databehandleraftaler med alle relevante leverandører.

10. DINE RETTIGHEDER

Du har ret til:

· Indsigt i dine oplysninger

· At få rettet urigtige oplysninger

· Begrænsning af behandling

· At trække samtykke tilbage (hvor relevant)

· At klage til Datatilsynet Kontaktoplysninger findes på www.datatilsynet.dk.
